5. CONTENT. AVAILABLE THROUGH SERVICES

Provided as is: you acknowledge that Lawtet makes no representations or warranties regarding the material, data and information, such as data files, text, computer software, (collectively, “Content”) to which you appear access when using the site or through your use of the Services (Services, Services) Under no circumstances shall Lawtest bear any responsibility for any content, including but not limited to: any content that infringes copyrights, any errors or omissions in Content or for any loss or damage of any kind arising from the use of any content sent, transmitted, linked or available on the website or accessible through the Services. Working with Lawtest: Creating an account with Lawtest or using the Services cannot allow you to be considered a member, shareholder or affiliate of Lawtest for any conditions and does not give you any statutory member rights as defined in any law.

Termination: Lawtest reserves the right to change or terminate your account or service at any time for any reason or for no reason.

    – You may not (a) use any Service for any illegal purpose or in violation of any local, state, national or international law, (b) violate or encourage others to violate any right or obligation to a third party, including by infringement, misappropriation or infringement of intellectual property rights and confidentiality.

WE DO NOT WARRANT THAT THE FUNCTIONS OF THE SERVICES WILL BE UNINTERRUPTED OR UNINTERRUPTED, THAT THE CONTENT AVAILABLE THROUGH THE SERVICE WILL BE FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY server used LAWTEST, FREE, ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE GUARANTEE AND DO NOT GIVE ANY OBLIGATIONS IN RELATION TO THE USE OF THE CONTENT AVAILABLE THROUGH THE SERVICES IN THE CONDITIONS OF ACCURACY, RELIABILITY OR OTHER.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, are not responsible for any DIVERSITY IN ANY CONTENT PROVIDED THROUGH THE SERVICE OR AVAILABLE (INCLUDING CLAIMS RELATING TO THIS CONTENT), FOR YOUR USE OF THE SERVICES OR FOR ANY THIRD PARTY THROUGH THE SERVICES.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply to you. IN THESE JURISDICTIONS, THE ABOVE EXCLUSIONS AND LIMITATIONS WILL BE PROVIDED TO A GREATER EXTENT PERMITTED BY APPLICABLE LAW.

10. COMPENSATION

In accordance with the law, you agree to indemnify and protect the Lawtest, its employees, officers, directors, affiliates and agents from any and all claims, damages and expenses, including reasonable attorney fees, directly or indirectly resulting from (a) your violation of the Terms , (b) your use of any of the Usdug and / or (c) Content that you use in any of the Services.

11. PRIVACY POLICY

12. POLICY ON TRADEMARKS

Lawtest names, logos, badges and other trademarks may be used only with our consent, or in accordance with the Trademark Policy, if such is published on the website.

13. COMPLAINTS TO AUTHOR’S RIGHTS

Lawtest respects copyright, and we prohibit users of the Services from sending, downloading, publishing or otherwise transmitting any content on the Services that violates the rights of another person.

To report alleged copyright infringement of content posted on the website owned or controlled by Lawtest, send a Notice of Infringement as specified in the Digital Millennium Copyright Law (“DMCA”) “Notice and Remedy”.

14. TERMINATION

Lawtest: Lawtest may change, suspend or terminate or access all or any part of the Services at any time for any reason. In addition, your individual access to and use of the Services may be terminated by Lawtest at any time and for any reason.

You: if you want to terminate this agreement, you can stop accessing the Services at any time and not use them.

Automatically, after violation: Your right to access and use the Services (including the use of your login account) will automatically terminate after you violate any of the Terms. For the avoidance of doubt, the termination of the Terms does not require that you remove any link to the previously applied Lawtest legal tools from your own Content.

Subsequent actions: disclaimers, limitation of liability, as well as jurisdiction and applicable laws will remain with any termination of our cooperation. Your warranty and compensation obligations will continue for one year after our interaction has ceased.

15. DIFFERENT CONDITIONS

Choice of law: Terms are governed by and construed in accordance with Estonian law.

Dispute Resolution: The Parties agree that any disputes between the Lawtest and you regarding these Terms and / or any Services may be brought only to a court of competent jurisdiction sitting in Estonia, and you thereby agree to the jurisdiction and place of such court.

If you are an authorized agent of the government or an intergovernmental body that uses the Services in your official capacity, including an authorized agent of the federal, state or local government and you are legally restricted in accepting and acting under the law, jurisdiction or place indicated above, these provisions do not apply to you. For any such entities, these Terms and any related actions will be governed by the laws of Estonia.

Failure of refusal: the refusal of one of the parties, to insist on strict compliance with any of the Conditions, to ensure their implementation, will not be interpreted as a waiver of any provision or right.

Delegability: if any part of the Terms is deemed to be invalid or unenforceable in accordance with any law or decree or final determination of the competent court or tribunal, this provision will be considered separable and will not affect the validity and enforceability of the remaining provisions.

No agency relationship: the parties agree that there is no joint venture, partnership, collaboration, or agency relationship between you and Lawtest, as a result of using the Terms or using any Services.

Integration: These General Terms and any applicable Additional Terms constitutes the entire agreement between you and Lawtest relating to this subject, and supersedes any previous communications and / or agreements between you and Lawtest regarding access to and use of the Services.

The man’s summary of Section 15: If there is a claim arising from these conditions, it must be in Estonia and governed by Estonian law. We are glad that you use our Services, but this agreement does not mean that we are partners.
